Heard Sri C.S. Sharma learned counsel for the applicant and learned AGA for the State and perused the papers.
125 tablets of dizapalm are said to have been recovered from the applicant on 15.03.2007, which is below commercial quantity.
It is submitted that the applicant has been falsely implicated in this case by the police.
Next submission is that no public witness was called at the time of alleged recovery.
Having heard learned counsel for the parties and keeping in view all the facts and circumstances, without expressing any opinion on the merit, the applicant may be granted bail in the case.
Let the applicant Heera Lal yadav S/o Ram Pati Yadav involved in Case Crime No. 40 of 2007, under section 21/22 N.D.P.S. Act, P.S. G.R.P. Aligarh, District Aligarh be released on bail on his executing a personal bond of Rs. 25000/- and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
