Heard Sri Niraj Tripathi, learned counsel for the applicant and learned A.G.A. for the State and also perused the record.
In this case, one mobile is said to have been recovered from the applicant, which is said to be the looted property.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. and he has been falsely implicated in this case after apprehending him from his house. Next submission is that no witness of public was called at the time of alleged recovery. Last submission is that the applicant is in jail since 13.01.2007.
Having heard the parties' counsel and keeping in view all the facts and circumstances, without expressing any opinion on merit, the applicant may be granted bail in this case now.
Let the applicant Muradi S/o Bhoora involved in Case Crime No. 519 of 2006, under Section 392/411 I.P.C. P.S. Kabrai, District Mahoba be released on bail on his executing a personal bond of Rs. 25,000/- and furnishing two sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate concerned.
