Heard Sri Dharmendra Singhal learned counsel for the applicant and learned AGA for the State and perused the papers.
It is submitted that the main and named accused Dauji has been granted bail by this Court vide order dated 15.05.2007, passed in Bail Application No. 9494 of 2007 and hence the applicant also should be granted bail, because he is not named in the FIR.
Having heard learned counsel for the parties after going through the bail order dated 15.05.2007 (Annexure 8) on the ground of parity and merit also, the applicant may be granted bail in the case.
Let the applicant Neeraj S/o Pokhpal involved in Case Crime No. 22 of 2007, under section 363, 366, 376 IPC r/w 3 (1) 12 SC. ST. Act, P.S. Delhi Gate, District Aligarh be released on bail on his executing a personal bond of Rs. 25000/- and furnishing two sureties each in the like amount to the satisfaction of the CJM concerned.
