Heard Sri R.P. Tiwari learned counsel for the applicants and learned AGA for the State and perused the papers.

The applicants and co-accused Gurmeet Singh and Dilbag Singh are said to have kidnapped  Hardeep Kaur daughter of the complainant on 14.12.2006.

Main submission made by the learned counsel for the applicants is that the victim Hardeep Kaur has married to Gurmeet Singh by his free will and arrest of Gurmeet Singh and Dilbag Singh has been stayed by this Court vide order dated 09.02.2007, passed in Crl. Writ Petition No. 1396 of 2007 and hence the applicants should be granted bail in this case, because they have been falsely implicated.

From the order dated 09.02.2007 it transpires that the victim Hardeep Kaur had appeared in this Court before the Bench, which was hearing Crl. Writ Petition No. 1396 of 2007. She is major and is said to have married with Gurmeet Singh by her free will.

Having heard learned counsel for the parties and keeping in view all the facts and circumstances, without expressing any opinion on the merit, the applicant may be granted bail in the case.

Let the applicants Surjeet Singh  S/o Rudra Singh @ Kadhay Singh, Tabbu S/o Achhannay and Jamil S/o Bashir involved in Case Crime No. 33 of 2007, under section 363, 366 IPC, P.S. Cantt, District  Bareilly be released on bail on their executing a personal bond of Rs. 25000/- and furnishing two sureties each of them in the like amount to the satisfaction of the CJM concerned.
