This is an application for bail moved on behalf of the applicant Kamlesh Singh indicted in case crime No. 459 of 2006 under sections 409, 419, 420 I.P.C. P.S. Ahraura District Mirzapur .
Heard Shri Anil Kumar Tiwari , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that applicant has been made scapegoat by the Khand Vikash Adhikari, Robertganj, District Sonbhadra. The learned counsel submitted that quantity of the amount embezzled has not been mentioned in the F.I.R. or in the inquiry report. The learned counsel pointed out that amount was paid by the Bank to the individual whose houses were to be built.
The learned A.G.A. submitted that applicant misappropriated the funds allocated and released for housing under the Indira Avas Yojana.
I have taken into consideration the submissions advanced on behalf of the parties.
The quantity of amount embezzled having not been mentioned in the F.I.R. or inquiry report, I consider it to be a fit case for bail.
Let the applicant Kamlesh Singh indicted in case crime No. 459 of 2006 under sections 409, 419, 420 I.P.C. P.S. Ahraura District Mirzapur , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
