Heard parties' counsel on the bail application and perused the record.
It is submitted that no witness of public was called at the time of alleged recovery and due to enmity and party bandi, the appellant was falsely implicated in this case. Next submission is that the appellant was on bail in Trial Court which he has not misused.
Having considered all the facts and circumstances of the case, the appellant may be granted bail in this case now.
Let the appellant Arun S/o of Sri Shiv Narayan Mishra be released on bail on his executing a personal bond of Rs.30,000/- and furnishing two sureties each in the like amount to the satisfaction of the Court concerned.
On depositing half amount of fine, recovery of remaining half amount shall remain stayed.
