The petitioner is accused in case no. 146 of 2006 State Vs. Mukesh and others pending before Judicial Magistrate, Siddharth Nagar. The submission of the learned counsel for the petitioner is that the petitioner has been wrongly implicated in the case and as such the charge sheet submitted against him be quashed.
Having heard learned counsel for the parties and considering the facts and circumstances of this case, in my view, quashing of the proceedings of the said case is not warranted. However, in the facts of this case, this petition is finally disposed of with the direction that the petitioner is permitted to file objections through counsel till the stage of framing of charges and he may not be required to be present in person till framing of charges, if any. It is further provided that the Court concerned shall not grant any unnecessary adjournment to the petitioner and decide the matter expeditiously.
With the aforesaid observations/directions, this petition is finally disposed of.
