Heard Sri Alok Sharma learned counsel for the applicant and learned AGA for the State and perused the papers.

It is submitted that the applicant is not named in the FIR and the eye witness also had not named the applicant in the statement.

Next submission is that co-accused Sukhpal has been granted bail by this Court vide order dated 27.02.2007 and hence applicant also should be granted bail in this case.

Having heard learned counsel for the parties and keeping in view all the facts and circumstances, without expressing any opinion on the merit, the applicant may be granted bail in the case.

Let the applicant Sarvesh S/o Ahivaran involved in Case Crime No.                 154 of 2007, under section 363, 366 IPC, P.S. Jaitipur, District Shahjahanpur be released on bail on his executing a personal bond of Rs. 25000/- and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
