Heard learned counsel for the applicants and the learned A.G.A. and Sri B.N. Pandey and Sri Ram Ji Singh learned counsel for the complainant.
It is submitted by learned counsel for the applicants that according to the prosecution version the applicants discharges shots when the first informant was going to lodged the F.I.R. but due to this shot nobody received any injury. The case of the applicant is distinguishable with the case of the co-accused Shiv Ram Singh and Shiv Kumar. The applicants dis not cause any injury.
In reply of the above contents it is submitted that the applicants are very powerful persons. In case they released on bail, they shall tamper with evidence.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Rajendra and Yogendra involved in case crime no. 688 of 2006 under Sections 147,148,149,307,302,504,447I.P.C., P.S. Vijay Nagar l District Ghaziabad be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned with the condition that the applicant shall not tamper with the evidence and he shall report to the court of C.J.M. concerned in the first week of each month till conclusion of the trial t show his good behaviour.
In default of the above condition the bail granted to him shall be deemed cancel and he shall be taken into custody by the C.J.M. concerned.
