Heard learned counsel for the applicant, learned AGA for the State and perused the impugned judgment.
Trial court record be summoned. List on 30th July 07.
It is submitted by learned counsel for the appellant that no public witness was called at the time of alleged recovery and the appellant has been falsely implicated by the police.
It is also submitted that the appellant was on bail during trial and he has not misused the bail.
Having regard to all the facts, the appellant may be granted bail in this case.
The appellant-accused Sikandar is admitted to bail during appeal on executing a personal bond of Rs. 25,000/- and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
On depositing 50% amount of fine in Trial Court, recovery of rest amount shall remain stayed.
