Narendra Kumar And Another v. Surendra Singh And Others - WRIT - C No. 28835 of 2007 [2007] RD-AH 10938 (2 July 2007)
|
Hon'ble Janardan Sahai, J.
A suit for injunction was filed by the plaintiff/petitioner. In the said suit an application for temporary injunction was also filed. The trial court passed an order directing the parties to maintain status quo. By the impugned order the appeal of the defendant has been allowed. The finding of fact is that on the disputed property there is a school being run by the defendant and the plaintiff's possession is not established. It has also been found that the plaintiff could not establish his case that the disputed property is portion of khasra plot no. 98 being claimed by the plaintiff. The finding is one of fact and is not shown to be vitiated by any error of law, which may call for interference under Article 226 of the Constitution. Dismissed.
