HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Amitava Lala,J.

Hon'ble Shishir Kumar,J.

This is an appeal of the Insurance Company.  The dispute has been raised with regard to the name of the deceased whether he is "Subhash" or "Tula Ram".  The dispute has also been raised in respect of profession of the deceased whether he is a daily labour or he is working in a repairing shop.  All questions were categorically considered by the Tribunal.  We do not find any infirmity in respect of such factual consideration on the basis of the evidence.

Thus, we do not want to interfere in the appeal.  Hence the appeal stands dismissed.

However, no order is passed as to costs.

The statutory deposit of Rs.25,000/- made  before this Court will be remitted in favour of the concerned Tribunal as expeditiously as possible.
