It is submitted by the petitioners' counsel that there was already a plea taken in the written statement that the property in dispute was the acquisition of the father of the defendant nos. 2 to 4 but by inadvertent mistake the averments of paragraph 2 of the plaint that the property was owned by the common ancestor Shiv was admitted in paragraph 2 of the written statement.
Respondent no. 2 is represented by Sri H.P. Mishra. He prays for and is granted three weeks time to file a counter affidavit. Petitioners will have three weeks thereafter to file a rejoinder affidavit.
Issue notice to respondent no.1. List this case in the week commencing 20.8.2007.
Until next date of listing further proceedings in Civil Appeal No. 21 of 2006 shall remain stayed.
