Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. but during investigation the name of the applicant has been disclosed after two and half months of the alleged incident. The applicant has been named by the persons who are not named as a witness in the F.I.R.. The applicant is not having any criminal antecedent.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ramvir involved in case crime no. 46 of 2006 under Sections 147,148,149,307,302 I.P.C., P.S. Matsena District Firozabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
