Learned counsel appearing for the appellant company contended that the ownership has been transferred to some other person,but the same has not been recorded anywhere particularly in the record of Vehicle. Moreover the owner which has been covered by the Insurance Company is also party to the proceedings. Under such circumstance, we do not find any infirmity in respect of awarding the compensation in favour of the family members of the deceased. We also do not find any infirmity in respect of quantification of the amount.
Thus, we do not find to interfere with the appeal and the appeal is accordingly dismissed. However, no order is passed as to costs.
The statutory deposit of Rs.25,000/- made before this court be remitted in favour of the concerned Tribunal as expeditiously as possible.
