Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record.
It is contended by the learned counsel for the petitioner that the petitioner is the wife of Fateh Singh. Fateh Singh is missing. A report of missing is registered at the concerned police station but she could not get the copy of the same, as a consequence she made an application under Section 156 (3) Cr.P.C. bearing Misc. Case no. 30 of 2006 and the learned magistrate after receiving a report from the police station concerned to the effect that a report of missing is registered, the application was dismissed on 3.8.2006, a copy of the order is appended is Annexure 3 to the petition. His further contention is that there is no trace of her husband and no effort has been made by the police to trace out the husband of the petitioner.
At this stage, learned AGA submits that a week's time be granted to seek necessary instruction and to file counter affidavit. Ten days' time is granted to him for the purpose.
List on 05.2.2007, the day the S.O. Of the police station concerned shall appear before this court and file counter affidavit annexing the copy of the report of missing and to disclose what effort has been made by him for the trace of abovenamed Fateh Singh.
Let a copy of this order be furnished to the learned AGA free of cost by tomorrow for intimating the authority concerned.
