Om Prakash & Others v. The Addl. District Judge, Court No.2 & Others - WRIT - C No. 25372 of 2007 RD-AH 11170 (4 July 2007)
Hon'ble Janardan Sahai, J
This petition has been filed against an order passed in a pending appeal directing the parties to maintain status quo. It has been clarified that the injunction order would not affect the Gaon Sabha in which the land vests. Thus the interest of the true owner has been protected. The appeal is still pending. The order of status quo is an interlocutory one and does not suffer from any illegality. It is not a fit case for interference at this stage.
Counsel for the petitioner then prayed that the appellate court may be directed to dispose of the appeal within a time bound period.
Considering the nature of the dispute involved it is appropriate that the appeal be disposed of expeditiously and if possible within a period of six months from the date a certified copy of this order is filed before the appellate court.
With the aforesaid direction, this writ petition is disposed of.
