Heard learned AGA for the State -appellant and perused the record.
The occurrence is said to have been taken place in the intervening night of 15/16.06.1991. The report was made on the next day i.e. 16.06.1991 at 14.05 hours. In the FIR it is not disclosed that the accused-respondents committed the murder of deceased There is no evidence on record to suggest their involvement in the offence. The trial court appears to have discussed all the facts and circumstances on record including the statement of prosecution witnesses and the documentary evidence, while passing order of acquittal. Hence, interference in the trial court judgment is not warranted
In view of the above matter we do not find any ground to grant leave to file appeal.
Leave to appeal is refused.
