HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Janardan Sahai, J.

     The caveator/respondent is granted three weeks time to file a counter affidavit. The applicant will have three weeks thereafter to file a rejoinder affidavit.

     List in the week commencing 5th November 2007.

    The execution of the decree passed by the trial court shall remain stayed provided the applicant deposits within a period of three months from today the entire decretal amount as well as the damages from the date of the decree till date at the rate of Rs.1,000/- awarded by the trial court and also continues to deposit thereafter the damages at the same rate by the 10th of each subsequent month.

       In case of default the order shall stand vacated. The amount so deposited may be withdrawn by the respondent.
