This petition seeks quashing of the award passed by the Labour Court in Adjudication Case No.339 of 1994.
The respondent workman was appointed as Trade Boiler Attendant for a period of three years from 9th March, 1982 to 8th March, 1985. After a period of almost a decade, he raised an industrial dispute whether he had been rightly removed w.e.f. 9th March, 1985. The Labour Court by the impugned award has reinstated the workman.
Learned counsel for the parties are agreed that the matter is covered by the judgment of this Court rendered in Writ Petition No.31352 of 1995 decided on 21st July, 1997 and Writ Petition No. 17762 of 1995 decided on 24th November, 1997. This Court in these petitions had quashed the award of the Labour Court which had directed for reinstatement of the workmen similarly situated as the respondent workman.
For the reasons stated in the aforesaid judgments, this petition deserves to be allowed and is, accordingly, allowed. The award of the Labour Court dated 24th May, 1997 is set aside.
There shall be no orders as to costs.
