Petitioner has committed default in payment due qua the Krishi Credit Card issued in his favour. He seeks indulgence of the Court for making payment in easy instalments. Petitioner is an agriculturist dependent upon the crop of sugarcane. Counsel for the bank has no objection if the payment is made by the petitioner in easy instalments but only if the petitioner is put to certain terms before any indulgence is granted.
Accordingly the present writ petition is disposed of with the following directions :
(a) The petitioner shall deposit 1/4th of the amount outstanding within six weeks from today i.e. up to 17th August, 2007.
(b) The balance amount shall be paid by the petitioner in three equal instalments of three months duration. First of which shall be paid on or before 17th November, 2007, the second by 17th February, 2008 and the last by 17th May, 2008. If the payments are so made, the petitioner shall not be asked to pay any recovery charges and the Krishi Credit Card shall be renewed.
In case of non-compliance of any of the conditions incorporated herein above, the petitioner shall not be entitled to the benefits of this order.
