Babu Sah Sayed v. State Of U.P. And Others - WRIT - A No. 109 of 2007 RD-AH 11436 (9 July 2007)
Hon'ble Ashok Bhushan, J.
Heard counsel for the petitioner and Sri K.Sahi appearing for the respondents.
By this writ petition the petitioner has prayed for quashing the impugned order dated 12.12.2006 suspending the petitioner. Sri K. Sahi, learned counsel for the respondents submitted that after filing of this writ petition on 2.1.2007, petitioner filed another writ petition being writ petition No. 23350 of 2007 by which he again challenged the same suspension order. This writ petition was taken up by this Court on 4.1.2007 and the learned counsel for the petitioner was allowed two days time to make necessary parties in the memo of writ petition. It appears that the said order was not carried out and the second writ petition was filed by one Devendra Deo Advocate who has also filed an application in this writ petition praying that the writ petition be dismissed as not pressed. Earlier writ petition having been disposed of by this Court on 17.5.2007 refusing to interfere with the impugned order and directing the disciplinary enquiry to be proceeded with, the petitioner cannot be granted any relief in this writ petition. The application of the petitioner for dismissing writ petition as not pressed is allowed.
The writ petition is dismissed as not pressed.
