Heard learned counsel for the petitioner, learned AGA for the state and perused the record.
The matter relates to Mines and minerals (Concession Rules 1963). The impugned FIR has been lodged in regard to some allegations. Learned counsel for the petitioner submits that by virtue of Rule 74 of the said Act that the complainant is permissible not the FIR, but the impugned FIR has been registered and pursuance to which the police is trying to effect the arrest of the petitioner.
Considering the facts and circumstances of the case issue notice to O.P. No. 3 to file counter affidavit.
Connect and list along with Crl. Misc. Writ Petition No. 7619 of 2007.
Till the next date of listing or till submission of charge-sheet, whichever is earlier, the arrest of the petitioner namely Girish Narayan Singh, in case crime no. 464/07, under section 3, 57 and 70 of U.P. Minor Minerals (Concession Rules 1963) and Section 4 and 21A of the Mines and Minerals (Development and Regulation Act-1957 and Section 379 of I.P.C., P.S. Chopan, Robertsganj, District Sonebhadra, shall remain stayed provided the petitioner cooperates with the investigation.
