Heard learned counsel for the appellants and the learned A.G.A. for the State.
Perused the order of Sessions Judge and lower court's record.
It is submitted by learned counsel for the appellant that it is a case of circumstantial evidence. The evidences against the appellant are of last seen and recovery of blood stained of Group A on his clothes. The clothes of the deceased was also stained with blood of group A. It is further submitted that co-accused has already been released on bail against whom the evidence are of last seen and recovery of blood stained of Group A on his clothes. It is also submitted that incriminating circumstances are not put to the accused under Section 313 Cr.P.C.
Considering the facts and circumstances of the case, the appellant is admitted to bail.
Pending appeal, appellant Arvind, convicted in S.T. No. 120 of 2004 shall be released on bail on his executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realization of fine shall also remain stayed.
