Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for quashing the order dated 13.1.2007 passed by the District Magistrate directing for taking fresh applications for Shiksha Mitra. Petitioner's case in the writ petition is that his name was recommended by the Gram Shiksha Samiti which was approved by Block level which was not approved for publication due to two complaints filed against the selection. Two persons have made complaint that they have given application for Shiksha Mitra but their names were not included in the selection by the Gram Shiksha Samiti. The District Magistrate has directed for inviting fresh applications. The District Magistrate has taken the view that the selection of Shiksha Mitra has become very old and several amendments have been made regarding engagement of Shiksha Mitra and there is possibility of getting efficient candidates. Learned counsel for the petitioner contended that his name was recommended by the Gram Shiksha Samiti and he is entitled for appointment as Shiksha Mitra. The complaint of two persons was to the effect that although they have applied but their names have not been included in the selection. The District Magistrate being satisfied about their complaint directed for flesh selection. I do not find any error indirecting for fresh selection. However, it is made clear that in case the petitioner makes an application his application be also considered in accordance with law.
Subject to above the writ petition is dismissed.
