Heard counsel for the petitioner, Sri R.P. Dubey appears for respondent no.2. Learned standing counsel appears for the respondents No. 1 and 3.  No notice is being issued to the respondent no. 4 in view of the order which is being passed .

The petitioner's case is that he was selected by the U.P. Secondary  Education Service Selection Board for appointment as Assistant Teacher L.T. grade  for Social Science and  the name of the petitioner was sent for posting to the respondent no.4 but he was not  permitted to join. Petitioner filed writ petition No. 27454 of 2006 directing the Director of Education to consider the claim of the petitioner.  The Director of Education by letter dated 30.6.2006 has observed that the post in the institution  Bajaj Rashtriya Inter College, Fatehpur Sikri District Agra has been filled up and the  U.P. Secondary Education Service Selection Board was informed  for adjusting the petitioner to some other institution.   Learned counsel for the petitioner contended  that rule 13 (5) has been substituted by the  U.P. Secondary  Education Service Selection Board (Second Amendment)  Rules, 2007 in accordance with that  the petitioner can be adjusted to some other institution.

In the facts of the present case liberty is given to the petitioner to make afresh representation to the respondent no. 2 consider the case of the petitioner in accordance with the  U.P. Secondary  Education Service Selection Board (Second Amendment)  Rules, 2007.  In case any such representation is submitted by the petitioner within two weeks from today the same may be considered and disposed of in accordance with law expeditiously preferably within a period of two months from the date of production of a certified copy of this order.

With the above observations the writ petition is disposed of.
