Heard learned counsel for the petitioners, learned AGA for the State and perused the record.
Contention of the learned counsel for the petitioner is that no offence under section 384, 323, 504 IPC is made out. The false FIR has been registered against the petitioner under political motivation. pursuance to which police is trying to effect the arrest of the petitioner.
Considering the facts and circumstances of the case, the writ petition is finally disposed of with the direction that in case the investigation into the case crime no. 388 of 2007, under section 384, 323, 504 IPC, P.S. Captanganj, District Azamgarh, shall not be concluded till today, the same shall be concluded within a period of 3 months from the date of production of a certified copy of the order and till then the arrest of the petitioner shall not be effected, provided he co-operates with the investigation.
In case, the petitioner false to co-operate with the investigation the order staying his arrest shall be deemed to have been withdrawn.
