Shiv Gopal v. State Of U.P. Thru' Its D.M. And Others - WRIT - C No. 27853 of 2007 RD-AH 11642 (10 July 2007)
Hon'ble S.U. Khan, J.
In the prayer of the writ petition, it was initially typed that mandamus may be issued against respondent No.3. Thereafter, by pen the number was changed to 1. However learned counsel for the petitioner states that the relief claimed is against respondent No.3, i.e. Smt. Amita Bajpayee-care taker of trustee. No other detail of respondent No.3 has been given in the array of parties. Neither address has been mentioned nor even the name of the City. The prayer is that "issue a mandamus for restraining respondent No.1 to interfere in peaceful possession of the petitioner". Such a prayer cannot be granted in the writ petition.
Writ petition is accordingly dismissed.
