Heard counsel for the petitioner and the learned standing counsel. Sri R. K. Srivastava has appeared for the respondent no. 5.
By this writ petition the petitioner has prayed for a mandamus directing the respondent no. 2 to ensure joining of the petitioner at Bhandar Bindwaliya, Post Bhandar Bindwalia Tola Dubey Barawa Keshtra Naurangiya, District Kushinagar. The petitioner's case is that he was selected as Shiksha Mitra for Prathamic Vidyalaya Dusadhipatti, Village Bhandar Bindwaliya Toal Dusadhipatti District Kushinagar and submitted an application for permitting her to join but she has not been permitted to join. Petitioner's case is that the petitioner submitted representation to the Basic Shiksha Adhikari as well as to the District Magistrate. Copy of the representation dated 9.2.2007 submitted toi the District Magistrate has also been filed as Annexure-7 to the writ petition.
In view of the facts of the present case ends of justice be served in disposing of the writ petition directing the District Magistrate to consider and take appropriate decision on the representation of the petitioner dated 9.2.2007 expeditiously preferably within a period of three months from the date of production of a certified copy of this order.
With the above observations the writ petition is disposed of.
