Heard learned counsel for the petitioner Sri Madan Lal Srivastava learned Standing Counsel for the respondents Sri Alok Kumar Singh.

This writ petition has been filed with a prayer that the petitioner be permitted to continue or to enhance the lease period which was granted in favour of the petitioner. The petitioner was granted mining lease on 10.1.1996 for a period of ten years which was valid up to 9.1.2006 in respect of Aarazi No 3567 Hall No. 7536 Gha, Raqba 0.62 acres situate at village Billi, Markundi, Pargana Agori Tehsil-Robertsganj, district-Sonebhadra for excavating Gitti and boulders. The petitioner was not permitted to operate the mining lease by the District Magistrate for a period of 7 months and 11 days. The petitioner submits that he has submitted an application to respondent no.2, District Magistrate for extension of period. Copy of the said representation has been filed by the petitioner as Annexure-9 to the writ petition. In support of his contention learned counsel for the petitioner has placed reliance upon a decision of the Apex Court in the case of Beg Raj Singh Vs. State of U.P. and others reported in A.I.R. 2003 S.C. Page 833.

In the facts and circumstances of the present case we direct respondent no.2 to decide the aforesaid representation of the petitioner within a period of three weeks from the date of filing of certified copy of this order by taking into consideration the judgment of the Apex Court and pass a detailed and reasoned order according to law.

With these directions the writ petition is disposed of.
