Afzal Ahmad v. Addl. Commissioner (Judicial) Moradabad Division & Others - WRIT - C No. 30843 of 2007 RD-AH 11778 (12 July 2007)
Hon'ble Arun Tandon, J.
It is not in dispute that the petitioner has already initiated suit proceedings under Section 229-B of the UPZA&LR Act being Suit No. 128 of 1980 in respect of the land in question. The suit proceedings have culminated in writ proceedings which is said to be pending before this Court being Writ Petition no. 21739 of 1998. It is admitted to the petitioner that the said writ petition filed by him, no interim order has been granted.
Since no interim order has been granted in the said writ petition, corrections in the revenue records are being made by the authorities in terms of the order which has been passed by the Courts under the UPZA&LR Act. Hence this writ petition.
In the opinion of the Court, the proper remedy available to the petitioner is to seek such ffurther interim protection in his pending writ petition no. 21739 of 1998 itself against the order impugned.
Writ petition is dismissed subject to the observations made herein above.
