The allegation in the FIR against the petitioner is that he had filled the examination form of Intermediate Examination of 1988 on the strength of fabricated transfer certificate and other certificates. In this writ petition, the petitioner has said that he had passed his High School Examination in the year 1983. He has enclosed a mark sheet of that examination showing that he had passed. According to his argument, if he had passed High School in 1983, there was no reason for him to submit fabricated certificates. However, the gap between 1983 & 1988 has not been explained anywhere in the writ petition. In normal course, upon passing High School in 1983 he should have appeared in the Intermediate Examination in 1985. The delay between 1985 to 1988 not having been explained at all, certificate of 1983 becomes suspicious.
Therefore, we would not like to record any finding of fact whether the enclosed certificate is genuine or fabricated. No case for quashing of the FIR is made out.
However, we direct that if the petitioner surrenders before the courts below in case Crime No. 04 of 2006 under Section 420/467/468/471 I.P.C., P.S. Hathras Junction, District Hathras/Mahamaya Nagar, and applies for bail, his bail applications will be considered by the courts below expeditiously.
With the above direction, the petition is disposed of finally.
