Smt. Bimla Devi And Another v. State Of U.P. And Others - CRIMINAL MISC. WRIT PETITION No. 771 of 2007 RD-AH 11949 (13 July 2007)
Crl. Misc. Writ Petition No. 771 of 2007
Hon'ble Sushil Harkauli, J.
Hon'ble K.N. Ojha, J.
This writ petition was filed in January 2007, based on an apprehension of the petitioners. No interim order was passed because no one appeared to press the petition. We are in July 2007 now. Since January 2007, no application appears to have been moved in this petition for early listing for urgent orders. Thus, it appears that the apprehension of the petitioners was not justified.
Even the writ petition does not say who harassed the petitioners and at what time and place. The petition is absolutely vague. We are of the opinion that on such vague pleadings no cause of action can be said to arise for filing the writ petition.
Moreover, as stated above, even if there was some apprehension because of the boy and the girl belonging to different religions, the fact that the petitioners have not applied for early hearing of the matter during the past six months indicates that the apprehension of the petitioner is not justified, or has ceased to exist.
Accordingly, we dismiss the writ petition, on the ground that it lacks cause of action.
