Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. whereas the other co-accused Shyam Babu, Babloo Pasi, Sandeep Rai are named in the F.I.R. After 20 days of the alleged occurrence the name of the applicant came to light in which the role of causing injury is not assigned to the applicant. It is said that at the time of the alleged occurrence he was seen driving the motor cycle.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ram Babu Yadav involved in case crime no. 447 of 2006 under Sections 147,148,149,302,120-B I.P.C.,and 7 Criminal Law Amendment Act P.S. Jahanganj District Azamgarh be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
