The fire arm of the petitioner was got deposited during assembly election. He has made an application for release of the same after the elections were over. On receipt of the application, the District Magistrate, Ghazipur called for reports on 4.7.2006 and thereafter no further action has been taken
Counsel for the petitioner submits that there is absolutely no reason to withhold the fire arm of the petitioner inasmuch as his fire arm licence has neither been suspended nor has been cancelled .
In the opinion of the Court the grievance raised by the petitioner requires immediate attention of the District Magistrate. It is, therefore, provided that the petitioner may make a representation ventilating all his grievances before the District Magistrate, Ghazipur within two weeks from today along with a certified copy of this order.
On such a representation being made the District Magistrate,Ghaipur shall call for the records and shall pass a reasoned speaking order strictly in accordance with law preferably within four weeks thereafter.
Writ petition is disposed of.
