Heard Sri G.S.Chaturvedi, learned senior counsel with the assistance of Sri S.B.Kochar, learned counsel for the petitioner, learned A.G.A. for the State and perused the record.
It is contended by the learned counsel for the petitioner that the petitioner was posted as Staff Officer (Executive Engineer) in the Office of Superintending Engineer, PWD, Lucknow. His duty was to open the tender. He is not concerned with any misappropriation of the money or fraud committed, as alleged in the impugned FIR. He is ready to co-operate with the investigation.
On the other hand, learned AGA prays that ten days' time be granted to seek necessary instruction in this regard.
As prayed, ten days' time is granted to the learned AGA to file counter affidavit.

Connect this petition with Crl. Misc. Writ Petition no.9502 of 2007.
The investigation into case crime no. 71 of 2005 under Sections 409, 419, 420, 477A/120B IPC and 13(1)(C), 13(1)(d) and 13(2) of Prevention of Corruption Act PS Rakabganj Distt. Agra shall go on but the investigating officer shall not initiate coercive measure against the petitioner provided he co-operates with the investigation.
