Sri S. K. Vdyarthi, learned Counsel for the petitioner submitted that the petitioner is a daily wager and for the claim of regularization and payment of minimum wages, a Writ Petition no. 8123/96 was filed. He submitted that the writ petition has been decided in terms of Division Bench decision in Special Appeal no. 653/95 State of U. P. Versus Putti Lal, wherein, the State Government was directed to frame rule regarding the regularization of the daily wager and has also directed to pay the minimum wages. Against the said order of the Division Bench, the State Government filed Special Appeal no. 3634/93 which has been disposed of by the Apex Court on 21.02.02. The Apex Court had granted stay order and directed for payment of minimum wages. He submitted that despite the order passed by this Court and the order of Apex Court, the Opp. Parties are not paying the minimum wages and not considering for regularization.
In view of the above, issue notices to the Opp. Party nos. 1 and 2 returnable within four weeks. The Opp. Party nos. 1 and 2 need not to appear in person.
