Heard learned counsel for the petitioner and learned Standing Counsel representing the respondents.
The petitioner claims to be Principal of the institution in question and has sent a proposal vide letter dated 27.2.2007 (Annexure-8 to the writ petition) for approval regarding appointment of class IV employees to the District Inspector of Schools. The petitioner's case is that no decision has yet been taken by the District Inspector of Schools.
Learned counsel for the petitioner submits that selection on the post of class IV employees, has been made with the prior permission of the District Inspector of Schools.
In view of the fact that the proposal of the petitioner is pending, ends of justice will be served in directing the District Inspector of Schools to consider the aforesaid proposal of the petitioner and take appropriate decision expeditiously in accordance with law. It is further observed that District Inspector of Schools shall consider as to whether in the entire district, there are persons, who are working on supernumerary posts and as to whether incumbent under Dying in Harness Rules are in queue.
It is made clear that this Court is not expressing any opinion with regards to the merits of the claim of the petitioner and it is for the District Inspector of Schools to consider all aspects of the matter and take appropriate decision in accordance with law. With the aforesaid observation, the writ petition is disposed of.
