Supplementary affidavit filed today is taken on record.
Learned counsel for the petitioner contends that no misconduct was committed by the petitioner on which the petitioner could have been suspended. He further contended that the petitioner was working as Head Master of Pradhmik Vidyalaya Bhainsara District Mathura and he was made in-charge of construction in another institution Kakretia to which petitioner has already submitted objection. Petitioner's case is that already a dispute is going on between the Head Master and Gram Pradhan and in continuance of that complaints were filed. Learned counsel for the petitioner has brought on record the enquiry report dated 2.6.2007 on the basis of which the petitioner has been placed under suspension. Certain technical short comings have been referred to in the report which cannot be held sufficient to place the petitioner under suspension.
Considering the facts of the case and the submissions made the impugned order dated 7.6.2007 shall remain stayed. It is however, for the respondents to change the in-charge of construction if they so decide.
Let a counter affidavit be filed within four seeks. List thereafter for admission.
