Petitioner has approached this Court questioning the validity of the order dated 30.08.1999 by means of which refusing to accord out of turn promotion to the petitioner.

Record in question reveals that on 25.05.1992 an incident took place wherein criminal Ram Babu was killed. On 01.08.1995 criminal Ram Sanehi was killed. Petitioner claims that on account of his participation, in the aforesaid case as he has shown exemplary courage, as such he was entitled to out of turn promotion. In order to give incentive to the police personnels who have shown exemplary courage Government Order dated 03.02.1994 have been promulgated to accord out of turn promotion.

 Incident dated 25.05.1992 which has taken place which is much prior to the issuance of provision  qua the same it has been mentioned by the Inspector General of Police, Kanpur Zone Kanpur that petitioner is not entitled to consideration his claim for grant of out of turn promotion, as said provision will not relate back to earlier incident.

In respect of incident dated 01.08.1995 record in question reveals that Inspector General of Police Kanpur Zone Kanpur has returned categorical finding of fact that it was normal case of encounter and the incumbent which was killed was not a notorious criminal and carried  no award, in this background  it has been mentioned that there is no case of according out of turn promotion.

Consequently no interference is required with the view taken and writ petition as it has been framed and drawn is dismissed.
