Smt. Nirmala Devi v. District Basic Education Officer Mirzapur - WRIT - A No. 31795 of 2007 [2007] RD-AH 12283 (18 July 2007)
|
Hon'ble Ashok Bhushan, J.
Heard learned counsel for the petitioner and Sri C.K. Rai, learned Counsel for the respondent No. 2.
The only prayer pressed by learned counsel for the petitioner is that the representation of the petitioner dated 15.2.2007 (Annexure-4 to the writ petition) with regard to her place of posting, be directed to be decided by the Basic Shiksha Adhikari expeditiously.
The petitioner's case is that she was asked to give her option, which she gave, but she has not been given posting at her opted place. Normally, it is not necessary to give posting to a person to the place of his/her choice. The learned counsel for the petitioner submits that no person on the post of Head Master is posted at the place on which the petitioner has given her option i.e. Prathamik Vidyalaya Hasipur and in the said school, the post of Head Master is still vacant. Learned counsel for the petitioner further submits that the petitioner has not been relieved from the present place of posting.
Considering the facts and circumstances of the case, ends of justice will be served in directing the District Basic Shiksha Adhikari to decide the aforesaid representation of the petitioner expeditiously.
With the aforesaid direction, the writ petition is disposed of.
