The petitioner is permitted to correct the description of respondent No. 4.
Issue notice to respondent no. 4. Learned standing counsel appears for respondents No. 1 to 3. Respondents are allowed four weeks' time to file counter affidavit.
List the writ petition in week commencing 27th August, 2007.
Learned counsel for the petitioner contends that the advertisement has been issued by the Manager on 4.6.2007 inviting applications for the post of Head Master of recognised Junior High School. He submits that the qualification mentioned in the advertisement is post graduate degree with B. Ed. /L. T. whereas according to rule 4 of the Uttar Pradesh Recognised Basic Schools (Junior High Schools ) Recruitment and Conditions of Service of Teachers ) Rules, 1978 only a degree from recognised University is required with teacher's training course and it is submitted that the advertisement is contrary tot he rules. The petitioner who fulfils the qualification cannot apply in view of above requirement in advertisement.
Considering the facts of the case and the submissions made, till the next date of listing further proceedings in pursuance of the advertisement dated 4.6.2007 shall remain stayed.
