Kashi Prasad And Ors. v. State - WRIT - C No. 4984 of 1977 RD-AH 12337 (19 July 2007)
Hon'ble Anjani Kumar, J.
Hon'ble Sabhajeet Yadav, J.
Heard learned counsel for the petitioners and learned standing counsel.
The petitioners, aggrieved by recovery which is initiated against the petitioners by Annexures-1 and 2 to the writ petition, have approached this Court under Article 226 of the Constitution of India. In view of settled legal position that this Court should not normally interfere with the recovery in exercise of jurisdiction under Article 226 of the Constitution of India, no case is made out for interference. However, with the consent of parties we direct that in case the petitioners deposit the entire amount, which is sought to be recovered from the petitioners, within a period of three months from today, the authority shall accept the same and no coercive measure shall be adopted against the petitioner.
With the above direction the writ petition is finally disposed of.
