Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He is the son in law of the deceased. The dead body of the deceased was found on the railway track. He has been impleaded in the present case only on the basis of doubt and suspicion. There is no direct eye witness account and nothing incriminating has been recovered from the possession of the applicant or at his pointing out.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Veeram Singh involved in case crime no. 864 of 2006 under Sections 302,201 I.P.C., P.S. Bhojipura District Bareilly be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
