Heard counsel for the petitioner. Sri V.C. Misra appears for respondent no. 6. Sri V. K. Singh has accepted notice on behalf of respondent no. 3. Learned standing counsel appears for respondents No. 1,2, & 4. No notice is issued to the respondents No. 5 in view of the order which is being passed. Liberty is reserved to the respondents No. 5 to move an application for clarification, variation and modification of the order if they feel so aggrieved.
Petitioner's case in the writ petition is that the petitioner has also applied for selection of Shiksha Mitra on which post respondent no. 5 has been selected. A representation dated 5.1.2007 challenging the selection of the respondent no. 5 has also been filed before the District Magistrate, Mahoba, copy of which has been filed as Annexure-7 to the writ petition.
The petitioner having already submitted representation challenging the selection ends of justice be served in disposing of the writ petition directing the respondent no. 2 the District Magistrate to consider the representation of the petitioner and take appropriate decision after giving opportunity to the respondent no. 5 and other affected parties. The said decision shall be taken expeditiously preferably within a period of three months from the date of production of a certified copy of this order.
With the above observations the writ petition is disposed of.
