Heard learned counsel for the petitioner and learned A.G.A. for the State

Perused the allegations of the F.I.R. and the material on record.

Issue notice to respondent no. 3 who may file counter affidavit within four weeks. In the meantime learned A.G.A. may also file counter affidavit. Learned counsel for the petitioners may file rejoinder affidavit within two weeks thereafter.

List thereafter.

Till the next date of listing or till submission of charge-sheet, whichever is earlier, the arrest of the petitioner  namely Phoolvas Yadav in Case Crime No. 368 of 2007 under Sections 419, 420, 467, 468, 471 I.P.C., P.S. Kasia, district Kushinagar shall remain stayed provided the petitioner cooperates with the investigation.
