By the order dated 22.03.06, this Court has directed the Opp. Party to consider the case of regularization of the petitioner.
It is alleged that despite the direction given by this Court, the case of regularization of the petitioner has not been considered. Affidavit of compliance has been filed by the Opp. Party annexing the copy of the order dated 20.11.2006, by which, the claim of regularization of the petitioner has been considered.
Learned Counsel for the petitioner submitted that from perusal of Annexure-1 reveals that the order was passed on 20.11.2006, but the same has been shown to have been dispatched on 18.06.07 after seven months. This shows malafide on the part of the Opp. Party.
Sri K. R. Singh, learned Standing Counsel submitted that he has instruction to say that the delay in dispatching the order was on account of lapses on the part of the dispatcher and for this lapses, the concerned dispatcher was chargesheeted. Learned Counsel for the petitioner submitted that the order has not been passed in accordance to law, if it is so, it will be open to the petitioner to challenge the same before the appropriate Forum.
In view of the above, notice is discharged. The petition is dismissed.
