Heard learned counsel for the appellant and the learned A.G.A. for the State and perused the lower court's record.
It is submitted by learned counsel for the appellant that the occurrence took place in midnight and the role of the appellant is only of catching hold. The deceased is said to have been assaulted by co-accused Rangoo. It is further submitted that it was a case of hit and run as the deceased had sustained single blow of knife.
Considering the facts and circumstances of the case the appellant is admitted to bail.
Pending appeal appellant Gyan Chandra convicted in S.T. No. 163 of 1995 shall be released on bail on his executing a personal bond and on furnishing two sureties each in the like amount to the satisfadction of the court concerned.
Till further orders realization of fine shall also remain stayed.
