Durga Das Tikiyani v. State Of U.P. And Others - WRIT - A No. 33329 of 2007 RD-AH 12681 (24 July 2007)
Hon'ble Ashok Bhushan, J.
Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for quashing the order dated 7.7.2007 by which the petitioner has been directed to be absorbed against the vacant post in Vimla Devi Inter College. Petitioner's case is that he has been working on the supernumerary post for the last about fourteen years but he was not absorbed, whereas, regular posts had fallen vacant in different institutions but the petitioner was allowed to continue to work on supernumerary post in the institution. By the impugned order dated 7.7.2007 the District Inspector of Schools has absorbed the petitioner on substantively vacant post in Vimla Devi Inter College. The mere fact that the District Inspector of Schools has taken the steps for adjustment of the petitioner now the impugned order cannot be faulted with. It was for the petitioner to raise objection on the vacant posts as claimed by him but on that ground no fault can be found in the impugned order.
The writ petition lacks merit and is dismissed.
