A prayer for bail has been made on behalf of the appellants, who have been convicted by the judgement and order dated 24.04.2007 passed by Addl. Sessions Judge, Court No. 9, Mathura, in S.T. No. 233 of 1998 (State Vs. Chandra Bhan and others) under Section 147, 148, 323 r/w 149, 302 r/w 149 I.P.C., P.S. Magorrah, District Mathura.
Heard learned counsel for the appellants and learned A.G.A. and perused the lower Court record and the order of Sessions Judge.
It is submitted by learned counsel for the appellants that there are cross-cases in which both side sustained injuries. It is further submitted that the accused were on bail during trial and the bail has not been misused. It is further submitted that the appellants are in jail for a long time.
Considering the facts and circumstances of the case and perusing the record, the appellants are entitled to bail.
Pending appeal appellants Harish Chandra, Sri Chand, Nakkan @ Parmanand, Banvari and Shiv Ram be released on bail on their executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the Court concerned.
Till further orders, realization of fine shall also remain stayed.
Office is directed to prepare paper-book and list this case for final hearing at an early date.
